U of A seeks dismissal of hazing suit

(March 15, 2004) — (Fayetteville-AP) -- The University of Arkansas wants a hazing lawsuit that a former track athlete filed to be dismissed. Kyle Cleveland of Conway filed the suit in February in Washington County Circuit Court against Kappa Alpha Psi Fraternity, the university and its board of trustees. Cleveland, who has since transferred to Alabama where he competes for its track team, alleges that members of the fraternity beat him so badly while he was a pledge in February 2003 that he was hospitalized with two broken ribs and a ruptured kidney. In documents filed last week, attorneys for the university cite the state's sovereign immunity among the reasons the suit should be dismissed
