Judge denies dismissal of Nichols trial

(April 21, 2004) - (McAlester-AP) -- Judge Steven Taylor is denying a motion to dismiss murder charges against Oklahoma City bombing conspirator Terry Nichols. Nichols' attorneys requested dismissal, saying prosecutors withheld evidence crucial to the defense. Taylor says there's no basis for the claims and that the motion "laced with melodrama but no substance." The claim includes an alleged videotape of the bombing and of other suspects in the bombing who've never been charged. Testimony in the trial is to resume with Michael Fortier on the witness stand. Fortier testified yesterday that McVeigh told him Nichols was deeply involved in the bombing plot and helped gather components for the bomb. Nichols faces 161 state murder charges for the bombing and prosecutors are seeking the death penalty.
